White & Case will be in court today (17 October) in the continued fight to prevent the extradition of retired businessman Ian Norris to the US.
London litigation head Alistair Graham is instructing Richard Gordon QC of Brick Court Chambers in Norris’s appeal against his extradition on price-fixing offences. Norris was formerly chief executive of industrial giant Morgan Crucible, but is now retired.
Lord Justice Auld and Mr Justice Field will hear the appeal in the Divisional Court today and tomorrow.
Norris’s appeal against his extradition follows earlier attempts to secure judicial review of the lawfulness of the Extradition Act 2003. The application for judicial review was thrown out by the High Court in February 2006, and permission to appeal to the House of Lords was dismissed in June.
Pharmaceutical group Goldshield is also facing price-fixing allegations by the US and is intervening in the Norris appeal. Jones Day partner Craig Shuttleworth is instructing Brick Court’s David Vaughan QC for the intervention.
Richard Lissack QC of Outer Temple Chambers and James Flynn QC, also of Brick Court, are appearing for the Serious Fraud Office.
The case echoes that of the NatWest Three, bankers accused of fraud connected with the collapse of Enron. The trio lost their fight against extradition in September 2006 and are now on bail in Texas. The House of Lords also dismissed their application for judicial review.
