They will speed ahead as the Bar becomes a two tier profession. There’ll be about 50 chambers which will survive and prosper. There may be, as well, a small number of very low-cost, specialist criminal chambers which get over themselves, stop moaning about how unfair it all is and make a business out of legal aid crime. There’ll be a lot in the middle who will just dither and wither. There are two things, only, stopping barristers’ chambers from creating some very good ABS structures. The first is their management structure which requires a fundamental and empirical reorganisation to equip it for that future and the second is their ‘ownership’ structure which, currently, disqualifies any chambers from acquiring any substantial working capital.
