John Langan (suing on his own behalf and as personal representative of the estate of Maureen Deidre Langan deceased) v Ministry of Defence QBD (Buckley J) 29 November 1999

Claimant: Widower of the deceased who died on 26 February 1988 aged 35.

Incident: Maureen Langan attended a military hospital in West Germany in July 1987 for the birth of her son by Caesarean section. She suffered a vaginal infection and experienced abdominal pain. A genital tract infection was later diagnosed and a laporotomy ordered. This was performed without success and Langan required a hysterectomy. In a further laporotomy her blood sugar levels destabilised. Langan was given an overdose of insulin causing her to suffer brain damage. She fell into a coma and later died. The claimant alleged negligence regarding his wife's death and his own nervous shock brought about by the events. Liability admitted in respect of Langan's death. Liability disputed in respect of the claimant's nervous shock.

Injuries: Langan suffered a vaginal infection, underwent two laporotomies, a hysterectomy and was given an overdose of insulin. She fell into a coma, suffered brain damage, anoxia and fitting and died six months later. The claimant suffered from nervous shock.

Award: £600,000 total damages (out of court settlement)

Steven Loveridge v White & anor QBD (HH Judge Prosser QC) 30 November 1999

Claimant: Male, aged 48 at date of accident; 57 at date of settlement.

Incident: The claimant was the driver of a car that was stationary in a line of traffic on the M3 on 26 February 1990. A pick-up truck crashed into the back of his vehicle causing injury to the claimant. The claimant brought an action against the driver and his employer. Liability admitted by the second defendant.

Injuries: The claimant suffered shock and whiplash injuries to his neck and back.

Award: £120,000 total damages (out of court settlement)

Gordon Gilchrist v Tahir Javed QBD (Eady J) 30 November 1999

Claimant: Male, aged 49 at date of accident; 55 at date of settlement.

Incident: The claimant was crossing Shoreditch High Street early on 10 April 1993 when he was struck by a car being driven by the defendant. Liability disputed.

Injuries: The claimant suffered head injuries which left him partly paralysed down the right side of his body.

Award: £431,232 total damages (out of court settlement)
