This is the first time that the Pensions Regulator has exercised its power to prosecute for breaches of the workplace pensions regulations.  Sarah Clarke QC has advised and acted for the Regulator throughout the proceedings.  The case will have far-reaching implications for the reputation of the Regulator and demonstrates its willingness and ability to use its full range of Enforcement powers.  It will also send out an important message to employers regarding the need for compliance with the occupational pension regime.
