Philip Rule of No5 Barristers’ Chambers, who is also an attorney in the Cayman Islands, has obtained an interim injunction, followed by undertakings, to ensure that his client is not returned to Jamaica without an assurance he will not face the death penalty. The action for judicial review was brought before the Grand Court in George Town, Grand Cayman.
The constitution of the Cayman Islands protects against the death penalty in a similar manner to the protection of the European Convention on Human Rights. In Jamaica, for some offences of murder, the death penalty remains available and there have been indications from Jamaica of a desire to recommence the execution of that sentence in the future.
