Piotr Kochański

Attorney at law, the Firm’s Founding and Managing Partner. Head of New Technologies and Media Law Practices

piotreDuring the systemic transformation in Poland in the 90s Piotr ran controversial, precedential cases in the IP protection, technology transfer, project finance and privatization areas of practice and complex, often multijurisdictional commercial litigation before the common courts and arbitration tribunals.

As a Polish Partner with Hogan & Hartson from Washington D.C., from 1991 to 1996 Piotr was active in a number of high profile legislative projects instrumental for the improvement of Polish Law and the Polish Economy in the new free market economy business environment. From 1996, as a Partner with White & Case from New York, he established and headed one of the very first teams of Polish lawyers and experts in the then brand new Intellectual and Industrial Property Law area.

Since establishing of his new, local Polish law firm in January 1999, Piotr has represented a variety of leading companies in Poland, many of which belong to the group of Polish subsidiaries of the world’s best known corporations. He has vast experience in providing legal services to companies from different sectors of industry, trade and services.

Piotr is considered an expert in the field of IP and Life Science and is recommended in the fields of commercial litigation and commercial arbitration, including the investment arbitration area of legal practice.

Between 1993 and 1995, Piotr lectured on the Legal Aspects of Technology Transfer at the George Washington University in Washington D.C.

Rafał Zięba

Rafał specializes in international financial, tax and business law, focusing particularly on the commercial and tax aspects of national and international transactions, including the creation of tax efficient holding structures and the development of tax strategies for the acquisition and divestiture of company assets. His clients include banks and financial institutions, companies active in the media, FMCG, R&D, automotive, pharmaceuticals and health care, food, real estate and construction, energy and mining sectors amongst others.

Rafał has been involved in creating the digital legal services market in Poland but has recently also concentrated on bankruptcy and insolvency matters. Founder of the Kraków office, he is currently practicing from Warsaw.

Rafał Rapala

Rafał has been involved in cases related to buy-and-lease-back of commercial properties and first public offerings. Paweł Borowski

Advocate, Partner. Head of Pharmaceuticals, Health Care & Life Sciences Law Practice

pawel-borowski-poziomePaweł specializes in pharmaceutical law, particularly with respect to matters connected with clinical trials, distribution and the sale of medicinal products, marketing and promotion of medicines, as well as refund proceedings. He represents clients in court proceedings pertaining to, inter alia, infringements of competition and distribution law, slotting fees and claims against the National Health Fund (NFZ).

He advises clients on projects related to competition and customer protection. He represents clients in matters of intellectual property as well as those related to the violation of fair competition. He participate in projects that concern the implementation of internal procedures within client operations – compliance.

Dr iur. Michał Będkowski-Kozioł

Partner. Head of Competition & Antitrust Law Practice

He has also advised clients in regulation related issues in the energy sector. His main areas of research and legal practice are: grid access issues, Third Party Access to electricity and gas infrastructure, pricing policy and regulation, renewable energy and co-generation projects, including regulation of the investment process and state support system, as well as energy law related procedures before the Energy Regulatory Authority and courts.

Since 1999, he has been an academic at the Law and Administration Faculty at the Cardinal Stefan Wyszyński University in Warsaw (since 2006 as an assistantprofessor in the Public Commercial Law Department), furthermore from 2007 a lecturer at the School of Management in Warsaw (Management Faculty in Ciechanów). In previous years he also lectured on constitutional, administrative and commercial law at the Law Faculty of Technische Universität Dresden in Germany.

Paweł Cholewiński

Anna Cichońska

Anna works for the Media & Entertainment Law Practice. Anna is highly experienced in press, copyright and general media law matters.

She specializes in protection of personal rights and the correction of press materials.

She is experienced in disputes with organizations for collective management of copyright, as well as in disputes relating to the provision of services by electronic means.

Anna provides day-to-day legal advice for businesses.

She has also conducted  a number of litigation cases before the civil and criminal courts as well as in mediation proceedings.

Szymon Gałkowski

Advocate, Partner. Head of Finacial Services Practice

He has also successfully advised clients in regard to various company financial restructuring projects as well as merger and acquisition transactions, banking transactions, and in the preparation of internal banking documentation.

Paweł Gunia

Paweł specializes in infrastructure,  construction, energy and public procurement law.

He provides comprehensive ongoing legal advice on issues related to the performance of construction contracts, in particular contracts based on FIDIC standards. He also represents clients in litigation relating to construction contracts, including disputes with employers and subcontractors.

Paweł has extensive experience in litigation before civil and administrative courts and in arbitration proceedings. He advises, among others, construction companies, energy companies (e.g. fuel exploration and production companies, coal-fired and renewable energy power plants, CHP plants, biofuel manufacturers), manufacturing plants, including heavy industry (e.g. chemical, pharmaceutical plants, steel mills, cement plants), transport, aviation, waste management  companies (including companies dealing with waste storage or energy recovery).

Anna Gwiazda

Małgorzata Jarosińska

She advises domestic and foreign enterprises on investment projects and transactions regarding real estate trade and management, as well as on construction law. She represents clients in various sectors, including international operators of shopping malls, logistic centers, commercial premises, developers, hospitals and clinics, FMCG producers, as well as from the pharmaceutical, chemical, metallurgy, automotive and media sectors.

Dr Marek Jeżewski

Partner. Manager of the Investment Arbitration Law Practice

He is a member of the Arbitration Committee at the Court of Arbitration at the Polish Confederation of Private Employers Lewiatan for 2014-2017.

Marek is a Vice-Rector for International Relations at the Stanisław Staszic College of Public Administration in Bialystok. He gives lectures on International Economic Law, International Investment Law and EU Economic Law at domestic and foreign universities. He is the author of the leading Polish monograph on International Investment Law (Międzynarodowe Prawo Inwestycyjne). Marek is also the author of numerous publications, published both in Poland and abroad. For several years he represented Poland in the work of the United Nations Commission on International Trade Law (UNCITRAL) participating in works inter alia on the rules of transparency in international investment arbitration.

Marek is a laureate of Rising Stars, a competition organized by Dziennik Gazeta Prawna daily newspaper.

Jan Kaczmarczyk

Advocate, Partner

jan-kaczmarczyk-2Head of the Aviation & Defense Law Practice. He specializes in corporate and commercial law as well as aviation law, in the broad sense. He advises in particular in Polish and international mergers and acquisitions, privatizations, private equity transactions, as well as public procurement and project financing.

He is experienced in advising clients in defense and aviation sectors, in particular on issues related to the privatization of state-owned enterprises operating in these sectors as well as in concluding and implementing supply and offset contracts with the State Treasury of the Republic of Poland. He has also represented business entities, airlines and individuals in connection with the acquisition, financing, registration and maintenance of aircraft.

Before joining KZP he worked as a senior associate at the Warsaw office of K&L Gates, as well as in the Warsaw office of Hogan & Hartson.

Dr Andrzej Malec

Tax Counselor, Certified Accountant, Partner.  Associate Professor and Rector at the Stanislaw Staszic College of Public Administration in Bialystok. Tax and non-standard legal problems expert at the Business Centre Club (BCC)

Andrzej is an expert in providing solutions to non-standard problems relating to a combination of law and economics, including commercial and investment arbitration proceedings and tax optimization.

Andrzej has a deep knowledge in logics (he has a doctors diploma in logics sciences) which is key to his ability for the creation of overall arbitration case strategy. He also possesses experience in assessment of potential claims and quantum of damages, as well as structuring legal argumentation.

Karolina Marciniszyn

Trademark and Patent Attorney, Partner. Head of the Intellectual & Industrial Property Law Practice and participant of the IP Law Practice

Karolina specializes in the management of industrial property rights portfolios, such as trademarks, domain names, industrial designs, patents and utility models.

She advises on matters relating to obtaining exclusive rights, and infringements of industrial property rights. She is highly experienced in industrial property litigation before the common and administrative courts and the Polish Patent Office as well as the Office of Harmonization for the Internal Market, conducted for clients inter alia from pharmaceutical, FMCG, alcoholic products, construction, banking and the luxury goods sector.

Dr Ireneusz Matusiak

He is the acting President of the Arbitration Court in Matters Concerning Internet Domains at the Polish Chamber of Information Technology and Telecommunications (PIIT), and he is the head of the Permanent Consumer Arbitration Court under the patronage of the President of the Office of Electronic Communications (UKE).

Ireneusz is an expert in all areas of intellectual property law. He has represented clients in litigation proceedings within the specialist fields of civil, commercial and labor law before the common courts, the administrative courts and the Supreme Court. Within these specialist fields, Ireneusz’s strengths lie in litigation proceedings relating to intellectual property rights, which includes copyrights, press law, performance of IT implementation projects and new technologies law (incorporating computer games); and litigation proceedings relating to the infringement of rights to patents, trademarks and internet domain names.”

Magdalena Mitas

Advocate, Partner. Head of the Energy & Environmental Law Practice

Expert in Energy and Environment for the Business Center Club. She is a lecturer at the Faculty of Law and Administration, Public Commercial Law Department, at the Cardinal Stefan Wyszyński University in Warsaw. Magdalena has authored more than a dozen legal opinions on draft energy and environmental laws, and academic articles. Since 2008, she has conducted workshops on energy, construction, administrative, environmental and anti-monopoly law for Polish and international energy companies. Magdalena Mitas has been recognized in energy and infrastructure law in IFLR1000 Energy and Infrastructure 2014: CEE ranking. She has also been one of the winners of the “Rising Stars 2014” awards organized by daily Dziennik Gazeta Prawna and publishing house LexisNexis.

Magdalena’s expertise includes comprehensive legal services relating to licensing, support schemes for renewable energy sources, energy tariffs, regulations of energy companies and transmission system operation and maintenance manuals.

Konrad Orlik

Kamil Osiński

Artur Piechocki

He was also a member of the Telecommunication Operators Group and the E-Media Committee at The Polish Chamber of Information Technology and Telecommunications (PIIT). He is also a co-founder of the Domain Names Arbitration Court at PIIT, where he was heading the works, and a co-founder of the domain case law in the Arbitration Court at the Polish Chamber of Commerce (KIG).

Adam Piwakowsk

In his role as Head of International and Strategy at Kochanski Zięba and Partners he takes a multi-faceted role acting as a bridge between English speaking foreign markets and the Polish legal jurisdiction, whether by assisting a new investor to take its first steps into the Polish market, working on cross border transactions, helping Polish companies access foreign markets as well as general business development.

In his unique role and with his wider view of the global legal market, Adam is a key strategist with respect to the development and growth of the firm, and is a driving force behind its innovative approach, with an impetus on bringing a new and modern way of thinking to the Polish legal market.

His legal background is firmly rooted in insurance law and general commercial litigation having practiced in the UK both in-house and at leading law firms for 10 years, providing general insurance and reinsurance advice, policy and compliance advice and assisting in large value dispute resolution, including property and professional lines.

Maciej Schmidt

Grażyna Sylwestrzak

She has experience in banking debt collection, in particular, debts resulting from bank enforcement orders. During her long experience of providing legal advice re: debt collection resulting from bank enforcement orders for a bank in Poland, which belongs to one of the largest capital groups in the world, she has developed a high level of professional skills.

Sylwia Sylwestrzak

Legal Counselor, Partner. Head of Copyright Litigation Law Practice and member of the Internet & E-commerce Practice and the New Technologies & Digitalization Practice.

Sylwia is highly experienced in press, copyright and general media law matters. As part of her professional experience she has advised on many IT  and, in particular, legal issues pertaining to the Internet. She is an expert on personal data protection, outsourcing and off-shoring services. She has also conducted many proceedings relating to personal rights protection. She has formed and co-formed the bases for operation of a wide range of e-commerce platforms, notably with respect to aspects concerning personal data and privacy protection.

She possesses rich experience in regard to the provision of legal advice to companies from the following sectors: IT, advertising agencies, media corporations, in carrying out proceedings for the protection of personal interest. Additionally, she worked in the legal department of one of the largest press publishing houses in Poland.

Tobiasz Szychowski

Tomasz Zaleski

Krzysztof Zięba

He has a wide range of experience in regard to the preparation and negotiation of trade agreements, including those which form a basis for the operations of supply chains (including commercial networks) and distribution agreements (including franchising systems and systems of selective distribution).

For many years Krzysztof has dealt with matters pertaining to consumer law and combating unfair competition (including, in particular, issues regarding so-called slotting fees).

He is also highly experienced in resolving domain name disputes, assisting clients to reclaim “cyber-squatted” internet domain names before the relevant dispute arbitration courts.

Apart from the pharmaceutical branch, Krzysztof also advises clients from the FMCG, chemical, food, cosmetics and automotive sectors.
