The Specific Relief (Amendment) Act, 2018 (Amendment Act) was published in the official gazette on 1 August 2018. The Amendment Act has been introduced with the primary intent of introducing greater certainty in enforcement of contracts and enabling faster and easier enforcement of contracts and resolution of contractual disputes.
The Amendment Act was introduced pursuant to the recommendations of the Expert Committee’s Report on the Specific Relief Act, 1963 (SRA), which was constituted to suggest measures to ensure that the law relating to specific relief is made more business friendly and enhance the ease of doing business. Provisions of the Amendment Act will come into force on such dates as may be notified by the Central Government.
