Khaitan & Co successfully represented Essel Mining & Industries Limited before the Hon’ble Supreme Court of India wherein the Hon’ble Court passed the order in favour of Essel Mining and allowed them to resume the operations of the mines Jilling Langlotta Mines and Koira Iron Ore Mines in the State of Orissa.

By a judgment dated 2 August 2017, a Bench of the Hon’ble Supreme Court presided over by Hon’ble Mr Justice Madan B. Lokur and Hon’ble Mr. Justice Deepak Gupta had directed mining companies operating in State of Odisha to pay compensation for mining without Environmental Clearance and Forest Clearance and directed that after making such payment and obtaining statutory clearances, the mining companies can resume operations.

Essel Mining had made the entire payment of approximately Rs.1717 crores towards compensation and had all statutory clearances with respect to two of its mines, Jilling Langlotta and Koira. However the State did not give permission for resumption of operations.

Upon hearing the submissions addressed on behalf of the client, the Hon’ble Bench was pleased to pass an order allowing the resumption of operations of the aforesaid mines by rejecting certain contentions of the Petitioner and the Amicus seeking to expand the scope of the Public Interest Petition in which the aforesaid Judgment was passed.
