Harbottle’s preconceived idea

It seems the law is forever finding ways to intrude into affairs of the heart. Unfortunately it sometimes has to.

A case in point is Harbottle & Lewis offering preconception contracts for prospective non-traditional families (see story).

Harbottle senior associate Linzi Bull came up with the idea after acting for a gay couple in a long-running custody battle.

In the case, a gay couple and a lesbian couple agreed to have children through IVF. Things went well for the family for a time, but then disintegrated into a bitter dispute that took a huge toll on the children.

According to Harbottle, the case shone a light on the pitfalls of non-traditional families failing to discuss their respective roles before conception, as well as the shortcomings of the law in dealing with these situations.

It might not be the most idealistic way to begin a family, but it might help avoid an acrimonious end.
