In 1867, the Marquis of Queensberry attempted to introduce fair play into the sport of boxing by the ‘Queensberry Rules’. Would Queensbury make a good trademark today for boxing-related clothing? Two entities thought it might.
Luigi La Mura (the defendant) established a small boxing gym under the name Queensbury in Bedford in 2004 and later a boxing agency. In 2006, the well-known boxing promoter Frank Warren (the claimant) decided to launch a clothing brand under the name Queensbury. He was initially unaware of La Mura’s activities. The two sides met in early 2008 and after that both tried to register variants of Queensbury as a trademark. Warren got there first. The parties discussed a joint venture but no agreement was ever signed and their relationship fizzled out.
In 2012, the defendant sought to launch a Queensbury line of clothing in a major sports store in London. The claimant obtained an interim injunction for trademark infringement…
