The use of video content is a staple of online news and entertainment reporting, but the difference between editorial and advertorial content can be blurred. For consumers this is an important distinction, and one the Advertising Standards Authority (ASA) is trying to clarify.

Walker Morris examines new guidelines issued by the ASA to ensure video bloggers do not mislead viewers. The guidance was issued after a complaint about a series of advertorial videos concerning Oreo biscuits. The videos included the text “Thanks to Oreo for making this video possible”, but this line was not deemed strong enough to make clear the marketing nature of the video. This issue led to some tricky decisions being arrived at by the Employment Appeal Tribunal, which often considers the case of care workers who are required to stay at work overnight.
