Effective from 1 July 2013, new rules governing personal data protection issues were adopted. The new act, no. 122/2013 Coll. on Protection of Personal Data (DPA), replaced act no. 428/2002 Coll. and introduced certain changes to the protection of personal data. In response to the DPA, DLA Piper has prepared a quick overview of the essential changes that were introduced along with a practical look at steps that should be taken to ensure the full compliance of your activities with the DPA.
As to the effectiveness of the DPA, the simple written assignment of the data processing is no longer sufficient. The controller (e.g. the employer who is processing the data of employees and clients) may assign the processing only via written agreement (an outsourcing contract) executed no later than on the day of the commencement of data processing.
The DPA also stipulates the minimal statutory content requirements of this contract, which includes a declaration by the controller that the proficiency of the processor, its technical and organisational ability to provide secure data processing and the ability of its personnel were taken into account during the selection procedure…
