Kings Chambers’ Jeremy Roussak enjoys success in asbestos-related claim

In Matthews v Collins & ors [2013] EWHC 2952 (QB), Jeremy Roussak, junior counsel at Kings Chambers, successfully resisted an attempt by the defendant to strike out as an abuse of process an asbestos-related claim after the claimant window had authorised the coroner to destroy retained tissue samples.

Swift J found that neither she nor her solicitors could be claimed for the destruction and that a fair trial was still possible.

The judge indicated that she intended to ask the chief coroner to give guidance to all coroners concerning retention of tissue samples after findings at inquest of death from industrial disease.
