Wierzbowski Eversheds advises the Insurance Guarantee Fund on multilateral agreement

Wierzbowski Eversheds has advised the Insurance Guarantee Fund (UFG) on a multilateral agreement on gathering and providing access to information in the Polish insurance industry, and has represented UFG in negotiations with dozens of insurance companies.

The purpose of the agreement, which has been joined so far by 24 insurers (together representing more than 90 per cent of the automobile insurance market in Poland), is to assure the highest quality of the data processed in the nationwide database of automobile insurers by:

  • imposing more rigorous requirements on insurers with respect to the data they provide;
  • introducing instruments to discipline insurers that do not meet the required conditions; and
  • modifying the mechanisms for supply of data by insurers and access to the data.

At Wierzbowski Eversheds, partner Gerard Karp, who is head of the firm’s privacy, information and communication technologies and electronic communications teams, was involved in the work on the agreement for UFG.
