No5 Chambers barrister Dean Kershaw has defended a recent Criminal Cases Review Commission (CCRC) appeal case. Sajid Ali, 41, of Aston, had his conviction of rape quashed after three Court of Appeal judges heard that jurors were not told the alleged victim had made a previous false claim of indecent assault.
The CCRC discovered the mistake made by West Midlands Police, which failed to find any trace of the previous incident during checks. The Court of Appeal heard that the background information about the alleged victim should have been made available at the trial.
Ali said he had suffered ‘five years of hell’ since being arrested, including spending two-and-a-half years in jail.
Lord chief justice Lord Thomas quashed the conviction and ordered that there should not be a retrial.
