Back in April 2013, in the article ‘Commission consults on the first draft of the new state aid de minimis regulation’, Walker Morris discussed the first draft of the state aid de minimis regulation that had just been published ahead of a consultation on the impending new legislation.
Now, in mid-July, the commission has issued a revised second draft of the regulation, which makes amendments to the first draft and again invites responses to the consultation.
The proposal maintains the current ceiling of €200,000 (£172,000) over three years. Aid given under that ceiling will therefore not constitute state aid in the meaning of EU rules as it will be deemed not to have an impact on competition and trade in the internal market…
