Nabarro has worked with the British Property Federation, Local Government Association and Local Partnerships to develop a guide that is designed to navigate the ‘legal maze’ of European procurement rules governing land and development deals.
The Official Journal of the European Union (OJEU) is the tendering process required by EC directives for public sector procurement. The regime has proved the source of much confusion and this complex and evolving area of law is regarded by many as a real barrier to development in the UK.
The new guide, which has been developed with input from developers, procurement lawyers and local authorities, is intended to provide high-level guidance to both contracting authorities and developers on the strategic choices open to them. It also identifies the most common structures used in land developments.
The guide was developed by the BPF Procurement Group in conjunction with the LGA and Local Partnerships and, in particular, with the assistance of Fiona Beattie (SJ Berwin), Rob Hann (Local Partnerships), Michael Chambers (BPF), Janet Lewis (Nabarro), Rob Groves (Argent [Property Development) Services]) and Rosemary Choueka (Lawrence Graham).
