Eversheds publishes competition law guide with Polish Association of Corporate Lawyers

Wierzbowski Eversheds, in conjunction with the Polish Association of Corporate Lawyers, has published a guide to key issues of competition law. The author of the report is Paulina Józefczuk, head of the firm’s competition law team.

The guide includes 16 chapters and answers basic questions related to the application of competition law in day-to-day business operations.

It presents numerous examples showing how the issues described are treated in practice in decisions by the president of the Office of Competition and Consumer Protection and the European Commission, and in the case law of the Court of Competition and Consumer Protection, the Polish courts of appeal, the Supreme Court of Poland and the European Court of Justice.

The last chapter is devoted to the most significant changes planned under the bill to amend the Competition and Consumer Protection Act approved by the Polish government on 23 July 2013 — including the introduction of fast-track merger review in simple cases, individual liability for anti-competitive practices by firms and voluntary submission to penalties.
