Most of us do not relish January and what follows closely on its heels. The Christmas season has been and gone and the new year’s bubbles are but a distant memory. Thoughts return to the workload on our desks that we all have put from our minds with mixed success.

But there are points of good cheer. The economy, after much stuttering, looks as if it is picking up speed. Clients who were nervous about initiating claims have resurfaced, and there is a more confident feeling in the air. It would be unwise to say that we are out of what some would say was a recession, but a corner, of whatever angle, has been negotiated.

In the field of litigation, we are all living in the brave new world of cost budgeting, with a consequent pressure upon fees. It will be interesting to see how the new regime settles down after the inevitably tough and uncompromising start that we can expect from the judiciary. But budgeting can be turned to advantage, in the sense of knowing with more precision the potential liabilities to costs that can assist a more sophisticated approach to risk management…
