Walker Morris defends FCC Environment UK in the Court of Appeal

Planning and environment lawyers from Walker Morris have successfully acted on behalf of FCC Environment UK in the Court of Appeal to defend a legal challenge to the planning permission for its energy-from-waste (EfW) facility at Greatmoor.

The case follows on from the claimant’s unsuccessful challenge in the High Court, which was refused by Mr Justice Lindblom in April this year. Had the renewed challenge been successful, the planning permission for the facility would have been quashed, with serious ramifications for the success of the project.

The Greatmoor facility is a key part of a sustainable waste management strategy developed for Buckinghamshire County. The EfW facility is intended to divert all of the residual waste produced by Buckinghamshire’s 500,000 residents from landfill. It is expected to treat up to 300,000 tonnes of waste generated by households and businesses in the county every year and to provide 40 skilled jobs.

FCC estimates that the facility will save the council more than £100m during the life of the contract and generate 22MW of electricity each year.
