Rihanna wins Top decision in t-shirt case - .PDF file.
Rihanna has won her High Court case against Topshop over their sales of t-shirts bearing her image.
Topshop had sold t-shirts with a photograph of Rihanna on them without obtaining a licence from her. The High Court ruled that this amounted to passing off.
The Judge was careful to say that there was no automatic right for celebrities to control reproductions of their image. Unlike some other countries, England does not have separate image rights. To succeed, a celebrity must show that there has been passing off, namely that consumers will be misled into thinking that the product in question has been authorised or endorsed by the celebrity when this is not in fact the case…
