Solicitors are being asked this month whether they want the Law Society to amend its regulations to restrict conveyancing solicitors in acting for both lenders and borrowers. The Law Society's policy committee has issued a questionnaire to all firms asking them to choose between four options: leaving the rules as they are; amending them so that joint representation of borrower and lender will only be permitted where the instructions for the lender are confined to ensuring good title; amending the rules so that joint representation is only permitted when the terms of the retainer to the lender are approved by the Law Society; and introducing a complete ban on joint representation.
