Litigation Writs 6/12/99

Brighton Marine Palace and Pier Co and Noble Leasing, both of Jarrow, Tyne and Wear, are suing NDT Services of Building Castle Donnington, Derby, for damages following an accident involving a ride in Brighton on 4 March 1995. The claim says the ride had been inspected and tested ultrasonically by NDT in 1994 and the inspection should have revealed the cracks in a shaft, which failed, causing the accident. It is alleged NDT was in breach of contract and negligent.

Harry Plews, of Flaxton, York, is suing the Public Trustee of Kingsway, London EC2, in respect of Flaxton Village Green and common land in York. He seeks an order that the Public Trustee be authorised and directed to execute a transfer of a subterranean strip of land there.

James Arnott of Basingstoke is suing for damages in respect of injuries he received in a road accident near Farnham in August 1996. He claims the accident was caused by negligent driving on the part of Sally Anne Heywood of Farnham.

Claim issued by Lewis & Potts, Camberley, Surrey

London based Black Sivalls and Bryson (UK) has launched a legal battle to recover documents. The company is asking the High Court to order International Systems and Controls Corporation, and Pierce Leahy Corporation, to return confidential papers. The claim alleges that the documents have been held by Pierce Leahy since 1975 following a storage agreement made between International Systems and Pierce Leahy. Black Sivalls and Bryson also seeks an injunction restraining the two companies from disclosing the documents.

An Addlestone police officer, medically retired after a road crash, is suing for damages. The claim says that David Cole, 35, suffered severe foot and other injuries when Ahmed Waseem allegedly drove a car through red traffic lights and hit his motorcycle. The claim says that as a result of the injuries Cole had to be medically retired from the police and is now handicapped. In his claim, he accuses Waseem of negligently failing to keep a proper lookout, going through red lights, failing to brake in time, driving too fast, and failing to give way. The claim also says that Waseem failed to have proper regard for the safety of other road users and to have entered a junction when it was unsafe. The accident happened on 17 April 1998 in Wimbledon.

Jersey based BLCT (27270) is suing Swiss Air Transport Co of London W1, for alleged rent arrears of £50,000 plus interest of £3,289.71 and continuing interest. The claim alleges the rent was due in September under a lease dated March 1995.
