Last week property company Arundel Corp won its application to amend its statement of claim to include fresh evidence which the company claims will show that Marios Pattihis lied in his written and oral evidence during a previous action.
Pattihis is due to appear at an appeal hearing in October in the case between Arundel and a former tenant over a rent review. Arundel will base its appeal case on the new evidence, which includes an affidavit by former Healys trainee legal executive Naresh Bhatia and allegations by former Healys solicitor Naresh Kumrai. Arundel hopes that this evidence will prove that the judge in the original action was misled by the perjured evidence of Pattihis.
It is alleged that, because the judge at first instance accepted the evidence of Khokher and Pattihis that the counter-notice had been served on time, Arundel, represented by Straiton & Co, lost its claim for it to establish Khokher’s rent level rather than it being subject to review.
Pattihis declined to comment.
