Anne Marie Fergusson, of St John, Jersey, has launched High Court action against solicitor Andrew Collins, of Northamptonshire, a partner in London-based Walker Martineau seeking return of money she claims she loaned him under undue influence.
She claims that between 1988 and 1993 she relied upon the defendant for legal advice in relation to her business and private affairs.
However, the writ claims that notwithstanding her marriage in 1985 and the divorce and remarriage of the defendant in 1985, she and defendant were lovers.
She says that in 1991 he told her he was in financial difficulty because of financial obligations to his divorced wife and children, obligations as a Name at Lloyd's, and obligations as a partner in Walker Martineau and that he needed to raise u140,000.
She claims she eventually lent him a total of u529,479 of which u140,000 has been repaid. The writ alleges the loans were procured by the defendants' undue influence. It says that in breach of his duty as a solicitor he did not advise her to obtain independent financial advice.
She seeks repayment of all sums lent by her, interest and an injunction to restricting Collins in dealing with or disposing of his assets.
