Noise award appeal takes off

A surveyor is appealing against damages of £10,750 awarded to East Sussex businessman Graham Farley. Farley took surveyor Michael Skinner to the High Court for failing to warn him of noise at his £420,000 home at Blackboys, Uckfield, East Sussex, from planes going in and out of Gatwick. Earlier this year Judge Peter Baker QC held that Farley, who regards the property as a country retreat, was entitled to damages. He said that Farley found the noise from the skies "a confounded nuisance" but was stuck with the noise and could do nothing about it. Skinner claimed that he had not received precise instructions relating to aircraft noise but had said in his report it was unlikely the property would suffer greatly from aircraft noise.
