RJB Mining (UK) is to claim damages in the High Court from two men it alleges have been trespassing on company land at Darton near Barnsley. Its writ is against Richard and Alwyn Mount of Barnsley and seeks declarations relating to rights of occupation of RJB's land to the north of Dayhouse Lane in Darton, along with orders for possession of the land, damages for trespass and a declaration that the men have no cautionable interest in the land or any part of it. It will also ask the court to vacate a caution entered against the land.

Harvey Nichols is suing Thames Water Utilities of Reading, for damages under s.209 of the Water Industry Act 1991. Its claim is in respect of losses caused by water escaping from a pipe in December 1996 and January and February 1997. The claim includes the cost of building a waterproof Calitite floor slab to contain water penetration at Harvey Nichols Knightsbridge store, the cost of delays in building retail space in the basement, and loss of revenue.

The Queen Mary's Sidcup NHS Trust is being sued by the Bexleyheath family of Susan Scotter, who claim she died as a result of the trust's negligence. Scotter's children Tara and Kirsty Scotter, and their father Mark Scotter, have issued a writ claiming damages under the provisions of the Law Reform (Miscellaneous Provisions) Act 1934 and the Fatal Accidents Act 1976.

Businessman Sir David Alliance, chairman of Coats Viyella, has launched a High Court action over a £10m property transaction. Sir David is suing Regent Holdings of Nauru, Central Pacific, over the property 43a Acacia Road, London NW8. His writ seeks an inquiry into the true value of the property and performance of a February 1998 contract between him and Regent Holdings for sale and purchase of the property. He also seeks interest at 1.5 per cent over Barclays base rate on £8.2m from 30 April, and on £1.8m from 3 March this year, along with a declaration that he is entitled to an allowance against the balance of the purchase price for the interest and that he has a lien on the property for £10m.
