Squire Sanders & Dempsey has brought a US arbitration involving adult retailer Ann Summers to a successful conclusion.
Douglas Rovens led the Squire Sanders team that advised Celine Gueyffier in a case against Ann Summers that claimed breach of contract after a business venture with the company collapsed.
The retailer was represented by Bryan Cave partners Jed White and Glenn Plattner.
The matter went to arbitration after Gueyffier’s business venture to sell Ann Summers products in the US came to an end, with the matter ultimately being decided in the California Supreme Court.
Rovens said: “The arbitrator concluded that our client had not received the training and guidance promised by the franchisor, which prompted our client to end the relationship.
“Because these breaches of contract could not be remedied, our client was not bound by a contractual agreement to give the franchisor written notice and 60 days to solve the problem before Ann Summers could be held in breach.”
The decision ended a three year legal battle over the failed franchise agreement.
