A doctor is taking his partners to the High Court in a battle over their moves to expel him from a medical practice. Christopher Duckham is seeking a High Court declaration that a notice purporting to expel him from the Horncastle Medical Group last December is invalid and of no effect. He is also seeking an injunction restraining four partners from expelling or compulsorily retiring him from the partnership, and implementing or trying to enforce the expulsion notice. Duckham is also suing his partners Timothy Watkins, Simon Read, Ranald Campbell and Lee Burman, all of the Horncastle Medical Group, The Old Vicarage, Horncastle, Lincolnshire, for damages for alleged breach of contract. His writ seeks a High Court declaration that the expulsion notice constitutes a repudiatory breach of the partnership agreement made between them on December 2 1997, and claims that because of the breaches he is discharged from any obligations under the agreement.

Alfred Dunhill Ltd, London SW1, is being taken to the High Court by Capital &Counties plc of the same address, in a claim over costs of a lease of part of Empire House, at 175 Piccadilly and 52 – 53 Jermyn Street, London SW1, which expired on December 24 1998. Capital & Counties claim they licensed Alfred Dunhill to alter the property, on condition it would reinstate it if required, and that on October 13 1998 it served Dunhills a schedule of dilapidations, notice of repair and reinstatement. But it alleges that in breach of covenants Dunhills failed to repair, renew, redecorate and keep the property in repair, and failed to reinstate it. The writ claims that the work necessary is likely to take ten weeks, and that with fees and VAT the cost will run to nearly u171,000.
