News reaches Tulkinghorn that one particularly wise US judge recently ordered a bunch of warring lawyers to settle their dispute with a game of Rock, Paper, Scissors.
OK, the game was only to settle the location of where the sworn statement of a witness should be taken, but the concept is sound. Tulkinghorn is of the mind that judges across the land should adopt a similarly proactive stance to settling disputes.
Take the technology and construction court, for example. Forget all this new-fangled rubbish about getting judges to mediate disputes. Two lawyers, face to face, hands at the ready and bang! Row settled.
