The Law Lords have agreed to probe a procedural point in the case of a woman who sought to ward off a bank's possession proceedings in respect of her home. Barclays Bank is appealing in a case in which it is seeking possession of property jointly owned by two former employees, a husband and wife. At Watford County Court, Judge Simmons ruled that the wife was not entitled to allege that the bank had constructive notice in support of her claim without making an application to amend her plea. However, the Court of Appeal allowed an appeal by the wife against this decision.
