Citing Bush v Gore, a three-judge panel of the Ninth Circuit postponed the election for governor in California on Monday, saying the risk of miscounting votes is too high with the punch-card ballots still in use in some counties.
A federal judge ruled last month that there was a compelling public interest in allowing the vote to proceed on 7 October, but the Ninth Circuit held that the public’s interest in fair elections outweighed the state’s interest in timely elections, The Recorder reports.
