Herbies wins Aon case for BP

Herbert Smith is celebrating a major win on behalf of oil giant BP in a dispute with insurance brokers Aon.

Mr Justice Colman handed down judgment this morning (13 March) in the long-running litigation, finding that Aon had been negligent in placing and administering insurance for an offshore construction project.

Herbert Smith partners Terry Mehigan and Alexander Oddy were acting for BP, which was claiming $80m from Aon on its own behalf and on behalf of 22 subsidiaries and joint venture partners including Shell, Total, ENI and Conoco Phillips.

The case was heard over 10 weeks at the end of 2005. A further hearing will determine the level of Aon’s liability.

Mehigan and Oddy instructed Brick Court Chambers’ Andrew Popplewell QC for BP. Simmons & Simmons represented Aon, instructing Brick Court’s George Leggatt QC and 3 Verulam Buildings’ Tom Weitzman QC.
