Pyper v Hall: Pyper v MM Bell & Sons Ltd (1999) QBD (HH Judge Simpson) 15 November 1999
Claimant: Female, 43 years old at date of 1995 accident; 47 years old at date of settlement.
Incident: The claimant was first injured in 1986 when her vehicle was hit from behind by another car. She was still recovering when in 1995 her vehicle was hit from behind by a van. A third rear-end shunt accident occurred in 1997. She had previously brought an action against the driver in the 1986 accident, but settled in 1992.
Injuries: The claimant sustained whiplash in each accident. She suffered pain and restricted movement in her cervical spine. Following the 1995 accident, the claimant was unable to return to full-time work. The claimant's symptoms were unlikely to deteriorate, but would not improve.
Award: £63,000 total damages (out of court settlement). (£35,500 for the 1995 accident, and £27,500 for 1997)
