Eversheds rocks in hendrix appeal case

Eversheds has won in the Court of Appeal for Experience Hendrix, the estate of Jimi Hendrix. Purple Haze Records reproduced one of Hendrix’s Swedish shows without permission, but the court held that performers who died before the Copyright Act 1989 came into force are entitled to have their rights asserted, even if the show was in a country not in the EU at the time of the performance. Eversheds partners Nick Valner and Paddy Gardiner instructed 11 South Square’s Richard Arnold QC. Sole practitioner Clive Sutton instructed 13 Old Square’s Jonathan Turner for co-defendant John Hillman.
