SJ Berwin advises on new Business Court

A new Business Court in Fetter Lane to replace the Commercial Court will be developed by Delancy and Invista Real Estate funds, which has been advised by SJ Berwin’s real estate practice.

Michelmores advised her Majesty’s Court Service (HMCS) on the establishment of the Business Court, which is due to be operational by 2010.

Secretary of State for Constitutional Affairs Lord Falconer said at the launch today: “The new Business Court will house a world class institution to match the UK’s world class reputation for business law, which attracts cases from across the globe.”

The court, to be housed at the Rolls Building, Fetter Lane, will replace the overburdened Commercial Court at St Dunstan’s House and consolidate business cases which are also currently heard at various sites within the Royal Courts of Justice complex.

SJ Berwin real estate partners Nick Minkoff and Lewis Myers advised Delancy and Invista, while Michelmores commercial property partner Richard Honey advised HMCS.

The court will occupy 145,000 sq ft on a 30-year government lease, providing 29 courtrooms, 12 hearing rooms, 45 public consultation rooms and administrative office space.

The court will handle various aspects of commercial dispute resolution, including the work undertaken by the Chancery Division, Commercial Court and the Technology and Construction Court.

The top four floors of the building will be available for separate let, and will have a separate entrance hall on Fetter Lane.
