Burges Salmon set for farm judicial review

Burges Salmon and Nicholas Green QC have won permission to seek a judicial review of the Government policy of slaughtering healthy animals to combat Foot-and-Mouth disease on behalf of organic farmers Peter and Juliet Kindersley. The legal action is the first of its kind.

Mr Justice Richards stated last Thursday (29 March) that the Government was entitled to continue its policy, but that the Kindersleys had an “arguable case”. The hearing is due to begin today (2 April).

The Burges Salmon team is led by partner William Neville, who appointed Green of Brick Court Chambers. Due to prior commitments, Green will be replaced today by David Anderson QC, also of Brick Court. The Government has instructed Christopher Vajda QC of Monckton Chambers.

The Kindersleys are funding the High Court challenge on behalf of several Cumbrian farmers and organic farming research centre Elm Farm (The Lawyer, 26 March).
