White & Case has secured its second court victory on behalf of the state of Ukraine in less than a month
It successfully defended a claim brought by Monde Re, the insurers of Russian energy company Gazprom, to enforce in New York the tribunal award of the Russian Chamber of Commerce and Trade and Industry.
Partner John Willems acted for Ukraine, the shareholder of Ukrainian gas enterprise NAK Naftogaz. Gazprom successfully brought a claim against NAK because of a contract dispute concerning the transmission of gas by pipeline across Ukraine territory.
Monde can now appeal or go elsewhere to enforce the Russian arbitration judgment.
Willems said: "The [New York] decision runs counter to common perception that US courts are open to claims from anywhere in the world. It confirms that US courts will indeed observe limits as to the exercise of their jurisdiction."
Two weeks earlier White & Case London won for Ukraine a High Court case setting aside a $20m (£12.7m) debt order brought against it by Norsk Hydro. The court also set aside Norsk's application to enforce a Swedish arbitration award against Ukraine.
