u1.8m mortgage fraud solicitor struck off

FRAUDULENT solicitor David Duff, whose activities have cost the Law Society Compensation Fund approximately u1.88 million has been struck off.

The Solicitors Disciplinary Tribunal held that Duff, who ran his own practice as Phelps & Lawrence in Swindon, and who was given a two-year sentence at Winchester Crown Court in July 1993 for four offences of obtaining property by deception and three of theft, was guilty of unbefitting conduct.

In findings just published following a hearing earlier this year the tribunal said Duff had been convicted of “mortgage fraud” along with two solicitors clerks.

The tribunal heard Duff argue that despite his convictions he had not been guilty of unbefitting conduct.
