Trademark case goes to Lords

The Law Lords are to consider the question of trademark infringement in the case of Scandecor Development AB v Scandecor Marketing AB & ors. They have just granted leave for Scandecor Development to appeal against an Appeal Court decision in July last year, in which an earlier ruling giving it partial victory in its claim was overturned and judgment was entered for Scandecor Marketing.

The legal battle is about the use of the name Scandecor in posters, calendars, cards, pictures, prints and other goods. Scandecor Development accused Scandecor Marketing of passing off. However, the Appeal Court held that neither the word trade mark nor the logo trade mark had been infringed by the actions of Scandecor Marketing.
