How ironic. Rumours emerged last week that Herbert Smith is threatening real estate star Chris De Pury, shortly to depart to Berwin Leighton Paisner, that it will enforce part of a restrictive covenant policy that obliges departing partners to work a 12-month notice period, as well as the part that bars that person from working with particular clients for a further year.
Yet, as keen-eyed observers will have noticed, Herbert Smith senior partner David Gold is himself busy advising Freshfields Bruckhaus Deringer's former disputes co-head Jo Rickard, who left last September for Shearman & Sterling, over the restrictive covenant in her pension.
Rickard is threatening legal action against her old firm and it is understood that Freshfields is currently in mediation with her to head off a court appearance.
