I also cannot believe that the lawyers commenting on his choice did not point out this obvious fact. This will only serve to encourage people to do as Lee has done. How can any employer trust an employee when they know them to be dishonest and untruthful? Surely this goes to the heart of the relationship and is a breach of the implied term of trust and confidence even before the contract has got underway? I guess if Sir Alan is happy with this, then he has accepted the breach. He cannot therefore in the future demand honesty from Lee or justify a dismissal for gross misconduct if Lee turns out to be an habitual liar!
