A noise nuisance battle that will be significant to local authorities is to be decided by the High Court. Lord Justice Kennedy and Mr Justice Mitchell have reserved judgment in the case of London Borough of Haringey v Jowett. The council is challenging a noise abatement order granted by magistrates to the tenant of a council flat who complained of traffic noise from roads and a junction near his home. The council argues that it cannot be held liable for traffic noise and says the abatement notice subverts Parliament's intention under the Environmental Protection Act 1990 that traffic noise should not constitute a statutory nuisance.
