By Matheu Swallow.A Roman Catholic trust is suing leading tax silk David Goldberg QC,
whoseearnings are reported to put him in the "million pounds a year club".This is the
second negligence action against Goldberg in as many years.Last year, he successfully
defended an action brought by Matrix Securities.The Liverpool Roman Catholic
Archdiocesan Trus-tees Incorporated accusesGoldberg, a tenant at top tax practice Gray's
Inn Tax Chambers, of givingthem bad advice over tax on the sale of drink in November
1989.The trustees allege in the claim that they had to pay tax which they wouldnot have
paid if they had been given competent advice.The claim says that Goldberg advised the
trustees that their activities inselling alcohol and other drinks for profit at parish
clubs were exemptfrom income tax under the Income and Corporation Tax Act 1988.Brinsley
Nicholson, head of litigation at Linklaters, who is representingGoldberg, says: "Mr
Goldberg believes the advice he gave was at all timesimpeccable and the proceedings are
being defended."Linklaters is one of Goldberg's major clients.Leeds firm McCormicks
issued the claim on behalf of the trustees.
