hmrc I had occasion to serve a notice on the Labour Party when Blair was in the hot seat. They never even answered - as a result they are in breach of section 10 of the DPA 1998 and other parts, and as European law applies then they are also in breach of Euro Directive 95/46 from which our data laws arose, although only parts which minimise what they can be penalised for. A substantive challenge is on the way to see if this section can be used to injunct the Labour Party and its data controller as the Queen cannot be judged to be the data controller (of the Government) in this case, so it’s either Gordon Brown or Gordon Brown, unless he gives up the real culprit.
