In the event that the Claimant gets a "free run" at trial under the proposed costs shifting regime, is it anticipated that Defendant solicitors will try and break the back of claims by making aggressive Applications for breach of Directions, strike out etc and if that occurs, who pays for the costs of these Applications should the Defendant win, the Claimant or his/her solicitors?
