I am not sure how APIL feel that the Claimant will loose out. When the Jackson reforms come in the increase is intended to reflect the ammended structure of legal fees and the fact that Claimant's damages will be reduced to help cover them. Surely therefore any Claimant who commenced proceedings under the presesnt system and obtained a 10% uplift on their damages would be receiving an unjust enrichment?
