Lets hope he does not get to hear cases on - privilege or expert witness immunity. His understanding of former raises real issues and, as for latter, his lead judgment in Jones v Kaney is best summed-up by referring to the tour de force of the two powerful, reasoned dissents (Lord Hope and Lady Hale) - see last page of Lady Hale's dissent ; says it all. A case of a judge making law, not applying 400 years of precedent and judicial activism at its worse,
