Yes, this is a clear abuse of the SRA's power. Even HMRC don't argue that barristers who advise taxpayers on tax avoidance schemes should not be used by HMRC to challenge tax avoidance schemes (as long as the barrister has not been involved in the tax avoidance scheme in point and is not otherwise conflicted of course).
