Zoe's analysis rather puts the coach before the horses. The primary purpose of family law is not to reduce conflict - although of course it's helpful when it does. The primary purpose of family law is to achieve justice and fairness for children and parents. If minimising conflict were the purpose, why not automatically hand residence to, for example, the parent whose first name comes first in an alphabetical list? The government's, quite proper, attempts to address a wide-spread belief that the family justice system is far from gender blind deserves better.
